ICC and UNIDROIT launch public consultation for international investment contracts
The ICC Institute of World Business Law (ICC Institute) and the International Institute for the Unification of Private Law (UNIDROIT) have launched a public consultation regarding the draft Principles and Model Clauses for International Investment Contracts (IICs). The consultation is open until 15 September 2026.
A joint initiative undertaken by UNIDROIT and the ICC Institute, the project combines UNIDROIT’s expertise in developing uniform law instruments and ICC’s expertise in investment arbitration and the elaboration of model clauses for international contracts. It aims to foster the modernisation and standardisation of international investment contracts, in light of the evolving landscape of investment law and arbitration.
The draft Principles and Model Clauses for IICs are based on the UNIDROIT Principles on International Commercial Contracts (UPICC), which set out principles, commentaries and model clauses tailored to the specific characteristics of the investment contracts, with the goal of promoting greater legal certainty, a better balance between the interests of states and investors, and sustainable investment.
The ICC Institute and UNIDROIT invite all stakeholders, including states, international organisations, businesses, arbitral institutions, associations, academics and practitioners, to review the draft and submit their comments to the UNIDROIT Secretariat via IICs-consultation@unidroit.org by 15 September 2026 (midnight, Rome time).
