A sizable amount of attention has been dedicated to mediation with the International Chamber of Commerce’s (ICC) largest educational event, the International Commercial Mediation Week coming to an end last week.

To further celebrate this alternative dispute resolution practice, ICC has released two publications: “Mediation Practice” edited by Greg Bond and “Agreed!” by Thierry Garby.

Both authors are distinguished international mediators, mediation trainers and longtime participants of the prestigious Competition. Their devotion to the practice not only shines through in their work, but in their writing as well.

According to Greg Bond: “There is a large and diverse world of mediation and yet professional mediators often know too little about what other mediators are doing.” In his book, Mediation Practice: 8 Cultures, 16 Cases, 128 Creative Solutions, Mr Bond breaks this mould and examined the ideas and decisions of eight mediators, each of a different nationality, and asked them to provide insight as to how they would have analyzed and approached the same sixteen cases. The result is 128 diverse responses that highlight the various styles and techniques depending on the mediator’s backgrounds. “This book explores the options mediators have for designing process and what mediators can learn about process from each other by entering into a dialogue of best practice. We can learn a lot from each other and all the contributors to this book have already learned so much from our sharing of ideas,” said Mr Bond.

Moving from culture to psychology, Thierry Garby focuses on using “emotions as a tool rather than an obstacle” in his latest publication, Agreed! Negotiation/Mediation in the 21st Century. Outlining the difficulties in the practice of mediation, Mr Garby provides readers with new ideas and perspectives on how to more effectively manage parties’ feelings when negotiating or resolving disputes of all kinds. “Emotions are the key to problem-solving…if you cannot deal with them, no solution can be found; if you can, the conflict can either disappear or be easily resolved,” he said. . Mr Garby’s 30 years of experience is clearly demonstrated as he reveals what really happens when principles are put into practice and procedure. This publication is available in both English and French from the ICC Store.
