New 2025 Brazilian scale (in Reais) for Arbitration
In December 2024, the ICC Executive Board approved the new 2025 Scale in Reais, which applies to cases filed as of 1 January 2025 and administered by the Brazilian office of the Secretariat of the International Court of Arbitration (“Court”) of the International Chamber of Commerce (“ICC”).
The new 2025 Scale in Reais is a response to the depreciation of the Brazilian Real since the adoption of the Scale in Reais in 2021. While reassuring the quality of the ICC services and that arbitrators acting in cases administrated at the Brazilian office will continue to be properly remunerated, the new 2025 Scale in Reais keeps fulfilling the ICC commitment to remain competitive in the Brazilian market.
In 2023, ICC Arbitration involved 80 Brazilian parties (including 12 state-owned entities) in newly registered cases, and the ICC Court confirmed or appointed 60 arbitrators coming from Brazil. Brazil ranks sixth globally in terms of the nationality of parties and arbitrators. and have been among the most frequent nationalities in ICC Arbitration for the last 15 years. For this reason, in 2017 the ICC Court established the Brazilian office of the Secretariat in São Paulo (“SCIAB”) and introduced a scale in Brazilian Reais to bring more predictability to Brazilian parties as to costs.
