The event will open with a keynote speech by Alexander Fessas, Secretary General, International Court of Arbitration ® followed by a panel discussion. Recent developments in law and practice worldwide illustrate the growing importance of third-party funding in international arbitration. This panel will examine issues that counsel, funds, and claimants alike should take into consideration when drafting and entering into third party funding agreements. In particular, the panel will address the following topics: how to structure a third party funding representation and agreement , conflicts of interest and privilege issues (who is the client?), how to account for the possible discovery of adverse facts (i.e. corruption or other illegal conduct by claimant); and how to allocate enforcement risk and costs.

This conference is aimed at young arbitration practitioners of approximately 40 years and under: counsel, arbitrators, corporate counsel or academics. The ICC YAF Conference will be an ideal forum for young practitioners to exchange thoughts on international arbitration, and to enrich their network in the region.
