Non-Express Powers in Arbitration: Excess of Powers or Inherent Powers?
The conference will be organized around three panels, the first one on provisional measures in ICSID Arbitration, exploring issues such as: are ICSID tribunals empowered to order provisional measures when the Convention refers to a recommendation? Can ad hoc committees decide that a provisional stay be continued subject to conditions? The second panel will deal with the question of reconsideration of awards: Can an ICSID tribunal reconsider a decision preliminary to an award? Can an ICC tribunal reconsider an award on jurisdiction dismissing jurisdiction over some respondents when such award is later annulled in the country of the seat of the arbitration and the merits phase of the arbitration is still ongoing? The third panel will be on Iura novit Arbiter: can a tribunal decide a case on the basis of an argument neither raised nor discussed by the parties?

This conference is aimed at young arbitration practitioners of approximately 40 years or under: counsel, arbitrators, corporate counsel or academics. The ICC YAF Conference is an ideal forum for young practitioners to exchange thoughts on international arbitration and to enrich their network in the region.
