ICC YAF: Latin America Regional Conference 2016

The ICC Young Arbitrators Forum (YAF) is hosting a series of Regional YAF Conferences, one for each of the five ICC YAF Regional Chapters. The Latin American Conference will be held in Sao Paulo on 21 August 2016.

Description

Information:

This ICC YAF conference will include keynote debates, dynamic panels, participative workshops, round table discussions on topics that are of interest to each particular region. Sessions will be highly interactive and topics deliberately controversial to foster active participation.

Who should attend?

This conference is aimed at arbitration practitioners of approximately 40 years and under: counsel, arbitrators, corporate counsel or academics

In addition, this conference will provide great networking opportunities to strengthen links within the young arbitration community.

15:20- 16:20 Debate on “The so-called Due Process Paranoia”

According to the last survey of Queen Mary University of London “International Arbitration Survey: Improvements and Innovations in International Arbitration”, there has been a notorious increase in the due process paranoia which means that arbitral tribunals are hesitant to take certain decisions for fear that their awards are questioned, making difficult their recognition and enforcement. This scenario can occur at different stages such as the inclusion of third parties in an ongoing process and calculation of costs, among others. Moreover, this panel will also take a brief look at the ICC Commission Report on Arbitration & ADR “Effective Management of Arbitration”.

World Café is an interactive format which allows all delegates to participate actively in a series of simultaneous debates. Delegates will be invited to join different groups animated by ICC YAF Regional Representatives to discuss a variety of hot topics including:
• Pre- arbitral phase – Suggesting multitiered clauses to clients: good or bad?
• Choosing the arbitrators – Interviewing the arbitrator: good or bad?
• Uncitral Notes on Organizing Arbitral Proceedings – Consecutive or simultaneous submissions: good or bad?
• IBA Rules on the Taking of Evidence and “Sachs Protocol or expert teaming”: good or bad?
• Interim awards on jurisdiction issues: good or bad?
