In recent years, parties to investment arbitration proceedings have increasingly sought to disqualify arbitrators. One constellation that is said to justify a disqualification is that of a so-called issue conflict. The term refers to situations in which an arbitrator’s impartiality is lacking because of his or her prior involvement with related cases or issues. The event will explore to which extent issue conflicts can justify the disqualification of arbitrators – and how such disqualifications may affect the legitimacy of investment arbitration as a whole. This ICC YAF event will take place during the Frankfurt Investment Moot.
