Jointly organized by The International Court of Arbitration of the International Chamber of Commerce (ICC) jointly with and ICC Turkey, and in cooperation with TOBB, are organizing an Arbitration Day in Istanbul this conference will provide the participants with the updates on the latest trends in ICC arbitration.

Description

The conference aims to contribute to the development of international commercial and investment arbitration in Turkey, to promote Istanbul as a place for arbitration and alternative dispute resolution as well as the work of Turkish arbitration practitioners both on the domestic and international levels.

09:10 – 10:30Panel 1: ICC: A Centenary of Landmark Contributions to International Institutional Arbitration

 

Speakers from ICC Court and Secretariat will discuss the significant role played by the ICC over the past decades in shaping best practices in international arbitration and sustaining the attractiveness of arbitration as a fair, neutral and efficient method of dispute resolution. Furthermore, the panellists will share with the audience the features of ICC arbitration and the latest statistics reflecting the cases relevant to Turkey, and confirming the role of the ICC as the preferred international arbitration institution in Turkey.

 

A highlight will be shed on the new Rules of ICC as Appointing Authority and the role of the ICC Court acting as appointing authority in cases based on ad-hoc or UNCITRAL clauses, and how such role contributes to sustain efficiency and due process in the arbitration proceedings.

This panel will present a practical and insightful analysis of the challenging co-existence of common law and civil law approaches in international arbitrations, mainly in those featuring arbitrators and counsels from diverse legal backgrounds.

 

Topical discussions will include the procedural soft law and its increasingly important role today in international arbitrations (whether institutional or ad hoc). On this occasion, the panellists will  provide an overview of the IBA Guidelines on Evidence  and the Prague Rules and the guidelines therein with respect to conducting the evidentiary proceedings in international arbitration (document production, scope of discovery, the witness cross examination etc.)
